So many people in our County (and country) are under so much stress over their mortgage payments it is either making them ill or slowly destroying their relationships. As real estate agents, we see it every day.

We believe everyone bought their houses believing that owning a house would provide financial security, stability and a place for emotional security and warmth. That belief made perfect sense at the time: housing values were rising and for many folks owning a house was a perfect plan for forcing oneself to save for the future. But is that still the reality? Now that often the value of the house has declined below the mortgage balance still owed, home ownership is not financial security. It is an oppressive burden.

Now that interest rates have adjusted upward and many people are making less than in years past, the monthly mortgage payment is creating great instability and stress.

We are seeing that many a homeowner is either working so incredibly hard to pay the monthlies that he or she has no free time for relationships and fun, or is so stressed-out, he or she has no joy to share. Their house is no longer a place of emotional security and warmth.

The truth is, they would be happier paying a fraction of the mortgage payment by renting a comparable house, and getting their life back.

Many folks are fighting so hard to hang onto their houses they are making unwise decisions for the long term: cashing out retirement savings and even using credit cards to pay their monthlies.

Making mortgage payments on credit cards and using retirement funds is not sustainable. It is better to make the hard choice now and save for yourself and your family whatever remaining financial resources you have. Don�t give every last thing to the lender�save it to start building up again.

When you get to the point where you are either using retirement savings or credit cards, or are considering doing that, you need to stop and come up with a different plan.

At this point, the reality is that you have three options: 1) get a loan modification, 2) do a short-sale, 3) let the bank foreclose on your house.

The first option is the best, if you succeed with it. If you can get your loan modified so you are paying approximately the same amount you would pay to rent a home, then it probably makes the most sense to stay for the time being. (But even folks who probably could get a good loan modification may decide they are so far �under water� on the house, they want to get out of the liability of the big mortgage and proceed with a short sale anyway.)

The third choice you have is to walk away and let the bank foreclose on your house. The drawback to this choice is that you severely limit your options and the possibility of negotiating a good walk-away deal with the bank. You are completely at the mercy of the bank, and the bank can use the opportunity to �stick it to you� by adding onerous fees and charges onto the amount of the mortgage.

During the initial appointment we have with clients to start the short sale process, we help them review what happened, how they got where they are, and where they can go to start building on a solid foundation. Moving is a very emotional decision. In these times it is complicated by the feelings of failure and loss of a dream. It is interesting that no one ever thinks of people from the Great Depression as irresponsible or lazy or deserving of shame. They were people like us who made the best decisions they could and did the best they could at the time.

So it is with us. This is our time in history and we have to make the best decisions we can under the circumstances.

It is common for our short sale clients to feel guilty and blame themselves for getting into loans they can no longer afford.

Our take on it is that we all made good decisions at the time based on the information we had.

The housing boom coincided with an initiative to increase the number of homeowners in America. It was a good intention and a great idea for our country. Some banks and investment companies though found it a loophole to free themselves from prudent accounting practices and took advantage of it.

Loan agents were doing the job they were hired to do: selling their company�s products, like the loan you received, and were proud to be helping you achieve the American dream. The vast majority of them were doing good work, selling a reasonable product that was in demand.

At the time, no one foresaw the housing meltdown, especially here in Sonoma County. It seemed that since we knew our population was projected to increase by a sizable percentage every year, we would need new construction to house everyone and there would still be competition for existing houses.

Well, hindsight is 20/20, as they say.

This is our time in history, our Great Depression. All we can do is maintain our dignity, make hard choices, and get on with building a great life.

Tax Credit Extension for First Time HOme Buyers

Congress has extended and expanded the homebuyer tax credit. The modifications become effective "when" President Obama signs the bill. All changes made to the current credit become effective on that date, as well. This new change assists Current Homeowners also!

First Time Buyer – Amount of Credit - $8000 ($4000 married filing separate)

Current Homeowner – Amount of Credit - $6500 ($3250 married filing separate)

First Time Home Buyer Definition for Eligibility - Can not have had an interest in a principal residence for 3 years prior to purchase

Current Homeowner – Definition for Eligibility - Must have used the home sold or being sold as a principal residence consecutively for 5 of the previous 8 years Purchases after November 30, 2009. (Becomes April 30, 2010 on Date of Enactment.)

Binding Contract Rule - So long as a written binding contract to purchase is in effect on April 30, 2010, the purchaser will have until July 1, 2010 to close.

Income Limits (Note: Increased income limits are effective as of date of enactment of bill)-

The $8,000 federal homebuyer tax credit was set to expire on Nov. 30, but President Barack Obama recently signed the Workers, Homeownership and Business Assistance Act, which extended the tax credit to those who purchase a home or have one under contract to April 30, 2010.

Obama signed the new law on Nov. 6. It goes into effect immediately.

The $8,000 tax credit is still for first-time homebuyers or for those who have not owned a home in three or more years. The new law expands the program to include homeowners who have owned a home for five or more years, and qualifies them for up to $6,500 in tax rebates.

First Time Buyer � Amount of Credit - $8000 ($4000 married filing separate)

Current Homeowner � Amount of Credit - $6500 ($3250 married filing separate)

First Time Home Buyer Definition for Eligibility - May not have had an interest in a principal residence for 3 years prior to purchase

Current Homeowner � Definition for Eligibility - Must have used the home sold or being sold as a principal residence consecutively for 5 of the previous 8 years Purchases after November 30, 2009. (Becomes April 30, 2010 on Date of Enactment.)

Basically a Short Sale works like this:
1. We list your home for sale for a few weeks to obtain an offer.
Note: Usually the showing times are 10am to 6pm M-F only so as not to disrupt your home life.
2. We receive an offer we feel is best based on current buyer's market suggests.
3. I contact the bank and explain the hardship and why my client (you) are having trouble paying the mortgage. We deal with the lender(s)
4. Lenders realize there is a serious problem with many home owners and are deciding to sell with you, the property for less than the loan amount.
5. You finalize your move out/relocation/renting options that best suit your needs

We organize all details and take the headache away from you.
If you are currently paying your mortgage the bank has no reason to short sale.

Green Hauling - Eco-Friendly Junk Removal Service (novato)

I own and operate a local junk removal service where I try to do everything I can to be as eco-friendly as I can. I dont go to landfills (even though they can be much cheaper) instead I take all the debris to transfer stations. These transfer stations will sort out everything recyclable. I estimate 85% of all material i take in gets recyled out. I also run my truck on bio-diesel to further reduce my impact on the environment. I am also doing labor and moving to help people get the stuff ready to be taken away.
