The Prosecuting Attorney prosecutes these types of cases all day long. He knows--and is willing to use against you--all of the fine legal points that are available to him.

California law says that he only needs to prove that after drinking you were not able to drive your car safely or that your blood alcohol exceeded a certain limit. That sounds pretty cut and dried, but it's not quite as simple as that.

You see, if challenged, the prosecutor also has to show that the arresting officer made the arrest properly, that you were properly advised of your rights, that the equipment he used to test you was working accurately, and even that the person operating that equipment was certified to operate it. If he gets information which may prove you innocent, an attorney can make him give you that information also.

Absent an emergency, it may pay to do some bankruptcy planning before youf file.

Know what debt is non dischargeable.

If the bankruptcy is not going to be filed immediately, know what debt will survive the Chapter 7 filing in planning your financial life in the interim.

It may be to your advantage to maximize your payments to debts that are not going to be discharged (like taxes, secured debt, and family support) and cease paying dischargeable debts.

If all of your debt is dischargeable, you may be able to accumulate cash by not making payments on existing debt.

Cash advances on a credit card aggregating over $750 made within 90 days before the case is filed are presumed to be fraudulent and therefore non dischargeable. Any charges to credit cards after you decide to file bankruptcy, or even meet with a bankruptcy lawyer, are arguably non dischargeable because you didn't have an intent to pay the bill when you made the charge.

If taxes are involved, know exactly which taxes are priority: that means knowing about extensions of time to file tax returns (for calculating the "three year rule"); when a tax was assessed (the "240 day rule"); and when tardy tax returns were actually filed (the "two year rule") as well as any events that toll the running of the statute like offers in compromise.

Note that recent changes to the discharge provisions make loans used to pay non dischargeable federal taxes non dischargeable.

Maximize Exemptions.

Know what assets you are permitted to exempt from the claims of your creditors.

If you have significant non exempt assets, get good bankruptcy counsel about converting non exempt value into exempt value.

Courts are variable about what constitutes good bankruptcy planning versus what is a scheme to "hinder, delay or defraud creditors". Maximizing exemptions is traditionally permissible; hindering your creditors is grounds for denial of discharge.

I submit that these are but two ends of a continuum and drawing any lines along that continuum is art, not science.

If your assets exceed the exemptions available in your state, bankruptcy counsel can evaluate the extent to which those assets can be consumed or converted to exempt assets within the tolerances of the local judges.

Having substantial non exempt assets may also suggest filing Chapter 13 rather than Chapter 7.

Predict what transfers might be avoided

Debtors frequently want to protect creditors who are friends or family members from having to disgorge to the bankruptcy trustee payments made by the debtor or to pay off a credit card so they can keep it after the bankruptcy.

Payments made, or liens perfected, within 90 days of the bankruptcy may be avoided by the trustee as preferences. If the recipient of the transfer is an "insider", the look back period is 12 months. "Insider" is defined in 11 U.S.C. 101 and includes family members, partners, and corporations in which the debtor is a decision maker.

Preferences from a creditor's point of view.

It is not wrong for the debtor to make payment to one creditor over another on genuine debts. It is the creditor, not the debtor, who stands to lose if the trustee elects to avoid a payment as a preference.

If you want to provide for some creditors over others, you need to know whether that creditor is an insider and when the transfer is deemed made for purposes of the Bankruptcy Code.

The cost of filing suit to recover preferences from creditors usually limits trustee preference actions to transfers in the thousands of dollars.

As an alternative to paying the creditor's claim before bankruptcy, the debtor can also reaffirm a debt after bankruptcy, or just pay the debt voluntarily after bankruptcy, without a formal reaffirmation.

Avoid set off at the bank.

If you bank or have investments at an institution to which you owe money, on a loan or a credit card, that institution probably has the right under state law to take your money on deposit and apply it to your debt to them.

Thus, if you file bankruptcy owing a bundle on your Big Bank credit card, Big Bank can take the contents of your checking account at Big Bank on the day you file to pay the credit card bill.

So, good planning says "don't have your assets in institutions to which you owe money. "

You must get credit counseling before you file bankruptcy from a non profit agency approved in the district in which you will file.

If your income has been varied in the past six months, analyze whether you are benefited by filing sooner or waiting. Eligibility to file Chapter 7 and the terms of a Chapter 13 plan are now driven by your income in the six months before you file. More on the means test.

Although the right of set-off should not apply to funds deposited after the bankruptcy case is filed, the chances for bureaucratic snafus are ever present. Better safe than embroiled in telling a bank they violated the law.

Several weeks ago, Governor Schwarzenegger signed legislation which will effectively prohibit representation against your Lender in regard to obtaining a mortgage modification. This may very well be a good thing in that it will get rid of all the scam artists, whether it be Brokers or inexperienced attorneys, and force these complaints against the Lenders to where they should be adjudicated, and that is in the Courtroom. The dirty little secret no one knows is that the Lenders are more often not in compliance with the Truth in Lending Act "TILA". In regard to analyzing the probability of anyone's success in the courtroom, you need to obtain a loan audit by a qualified professional. This loan audit will clearly reveal all of the Truth and Lending violations by the Lender. While I hate to say this for fear of you thinking I am exaggerating, there are TILA violations in nearly every loan audit we have performed to date. Thereafter, the issue becomes of how significant and substantial the violations are; although, the Lenders are usually significantly deficient in their performance in this regard.

If you have a problem with your loan, the first thing is to have a loan audit performed to ascertain if in fact you have significant TILA violations. Our office has checked pricing throughout the Country and found that Real Estate Brokers have charged $1,200 to $1,500 on average, and Real Estate attorneys have charged $1,500 to $2,000 or more for a loan audit. Before our office will commit to the consideration of pursuing any litigation against the Lender, we first insist that before any litigation monies are paid, that you pay a $1,000 fee for a loan audit. Our office has been able to negotiate very favorable terms with a very experienced Real Estate attorney who has performed a large number of loan audits. Based upon our personal relationship, we have negotiated pricing that is reasonable and affordable.

If your Lender has been deficient in regard to its compliance with TILA, you may have an entitlement to rescind the loan, which can result in significant penalties, costs, attorney fees, and return of interest payments by the Lender. Whether you actually go through with the recission or not, it puts you in a strong position to negotiate with the Lender.

This is really a superior process to the former loan modification because the Banks didn't really want to do loan modifications. In the courtroom they have to show the court that they have complied with the provisions of TILA, and to some degree, relevant state statutes, rather than just playing the game and pretending they are doing loan modifications.

Last month, our office convinced California Superior Court to issue a temporary restraining order stopping the bank from foreclosing on a property just days before the sale date. More times than not, these cases would be filed in Federal Court because most Lenders are Federally chartered banks. If you are not on probation or facing any new charges, California Penal Code 1203.4 allows you after completion of your probation to have your felony or misdemeanor conviction expunged. In certain cases even if you are on probation, I may be able to file a motion to terminate your probation and then clear your record, so that you do not have to wait until your probation ends.

If your felony is a �wobbler� (a crime which may have been filed as a misdemeanor or felony by the District Attorney) I can also have your conviction reduced to a misdemeanor before I expunge it.

If your home is in foreclosure and you've tried to work out a solution with your lender and failed, a more drastic option available to you is bankruptcy. If you do consider bankruptcy, here are a few things you should know about how bankruptcy will affect the foreclosure process and your credit.

Automatic Stay

Probably the best benefit that bankruptcy offers when your home is in foreclosure is the automatic stay. This is an order issued by the bankruptcy court that temporarily puts a halt to all collection activities, including foreclosure, that are being taken against you. While your lender may be able to have the automatic stay removed in order to proceed with foreclosure, it may still give you time to work out an alternative solution with your lender.

Chapter 7

A Chapter 7 bankruptcy is filed by a debtor who wants to liquidate all of their debts and start new. However, a lien was likely placed on your home as security for your mortgage. Security liens are not dischargeable in a Chapter 7 bankruptcy. So, the most that a Chapter 7 bankruptcy can do for you is to buy you a little more time work out a solution with your lender. If you cannot reach an agreement, foreclosure proceedings will eventually continue.

Chapter 13

In a Chapter 13 bankruptcy, you propose a repayment plan to the bankruptcy trustee. If the trustee agrees to the plan, you will have a three to five year period to repay your creditors. Usually, the plan reduces your debt obligation. Your mortgage can be included in the repayment plan, but you will be expected to continue making current payments and additional monthly payments for the amount of arrearage until your mortgage becomes current.

If you don't have enough income to make your current mortgage payments, the required payments on the arrearage and the payments to remaining creditors under the repayment plan, you may still loose your home.

However, a Chapter 13 bankruptcy may help you if you have a second mortgage by reclassifying that mortgage as an unsecured debt, which has the lowest priority and may not have to be repaid if your available income after payment of necessaries (housing, food, clothing) is insufficient to repay all of your debts.

Other Considerations

Filing for bankruptcy has some negative consequences.

- The trustee may void a deed in lieu of foreclosure to your lender that was made within 90 days prior to filing for bankruptcy if there was any equity in your home

- The trustee may void any conveyance or transfer of your property if it was made with the intent to defraud your other creditors or when you were insolvent with a creditor if it was made
to defraud or if the agreement was made to defraud other creditors

- If you are late in making any payments under your repayment plan, your bankruptcy case may be dismissed and your lender will likely proceed with foreclosure

- A bankruptcy will negatively affect your credit score for 10 years making it more difficult to buy a house in the future

Bankruptcy is the option of last resort. You should thoroughly discuss this option and others with a bankruptcy or foreclosure attorney as early as possible in the foreclosure process.

If you have recently been in a car accident recently you may be experiencing some aches and pains. If untreated, these aches and pains could lead to future problems down the road. When you get in a car accident, soft tissues that hold your spine in place get stretched and torn. When muscles and ligaments are torn, chemicals are produced that fire local pain receptors. The firing if these pain receptors sends a pain impulse to the spinal cord and back to the area of injury resulting in local muscle spasms. These muscle spasms indirectly restrict the blood flow to the area of injury which in turn causes more tissue injury. The new injury results in more chemicals being produced and the cycle continues.

Besides chemical production, this cycle, if not interrupted, causes the nerve in which these impulses are traveling to change. The change results in a supersensitive nerve that then reacts to normal conditions in an abnormal way. In other words, normal sensations are observed as painful.

Eventually, injured tissue is replaced. However, the tissue that replaces the injured tissue is different from the original tissue prior to damage, resulting in the following properties:
1. A weaker replacement tissue
A fibrotic scar is always weaker than normal soft tissue due to the fact that a fibrotic scar is smaller in diameter with less cross bridging.
2. A less functional replacement tissue
Normally, the pattern of the tissue resolution gibes an area function. When the pattern of fibrotic replacement is disorganized, movement is disrupted, and function is impaired.
3. A more susceptible replacement tissue to future injury
It makes sense that an area of tissue that is replaced with weaker and less functional tissue will be more susceptible to stress. When tissue is stretched, weaker, and less functional tissue will be damaged first.
4. A more sensitive replacement tissue
Ligament and muscle tissue are not the only tissues replaced. Damaged nerves are replaced to restore sensory and motor control to the area. However, the replacement area is more sensitive, resulting in pain.

Who Can File for Chapter 7 Bankruptcy?

To assist you in making your decision about whether to file for Chapter 7 bankruptcy, we offer the following information regarding the eligibility rules for Chapter 7, including the new "means test."

Filing for Chapter 7 bankruptcy can be a powerful tool for dealing with overwhelming debt. But it isn't available to everyone. Here are some situations in which you will not be allowed to file for Chapter 7.

You Have Enough Income to Repay Your Debts.

Under the old bankruptcy rules, the bankruptcy judge had the power to dismiss a Chapter 7 case if he or she thought the debtor had sufficient disposable income to fund a Chapter 13 repayment plan. There were no hard and fast rules dictating when a judge should dismiss a case on these grounds. It depended on the facts of the case and the attitude of the judge.

Now that the new bankruptcy law has gone into effect, however, there are clear criteria that dictate who will be allowed to stay in Chapter 7 bankruptcy and who will be forced to use Chapter 13 bankruptcy if they want to file. Disabled veterans whose debts were incurred during active duty and people whose debts come primarily from the operation of a business get a fast pass to Chapter 7. All others must meet the requirements set out below.

How High is Your Income?

Under the new rules, the first step in figuring out whether you can file for Chapter 7 is to measure your "current monthly income" against the median income for a family of your size in your state. Your "current monthly income" is your average income over the last six months before you file. If your income is less than or equal to the median, you can file for Chapter 7.

If your income is more than the median, however, you must pass "the means test" - another requirement of the new law - in order to file for Chapter 7.

Do You Have Enough Disposable Income to Repay Some Debts?

The purpose of the means test is to figure out whether you have enough disposable income, after subtracting certain allowed expenses and required debt payments, to repay at least a portion of your unsecured debts over a five-year repayment period.

You Previously Received a Bankruptcy Discharge.

You cannot file for Chapter 7 bankruptcy if you obtained a discharge of your debts in a Chapter 7 case within the last eight years, or a Chapter 13 case within the last six years.

A Previous Bankruptcy Was Dismissed Within the Previous 180 Days.

You cannot file for Chapter 7 bankruptcy if a previous Chapter 7 or Chapter 13 case was dismissed within the past 180 days because:

- you violated a court order
- the court ruled that your filing was fraudulent or constituted an abuse of the bankruptcy system, or
- you requested the dismissal after a creditor asked for relief from the automatic stay.

You Defrauded Your Creditors.

A bankruptcy court may dismiss your case if it thinks you have tried to cheat your creditors or concealed assets so you can keep them for yourself. Certain activities are red flags to the courts and trustees. If you have engaged in any of them during the past year, your bankruptcy case may be dismissed. These no-nos include:

- unloading assets to your friends or relatives to hide them from creditors or from the bankruptcy court
- running up debts for luxury items when you were clearly broke and had no way to pay them off
- concealing property or money from your spouse during a divorce proceeding, or
- lying about your income or debts on a credit application.

In addition, you must sign your bankruptcy papers under "penalty of perjury" swearing that everything in them is true. If you deliberately fail to disclose property, omit material information about your financial affairs, or use a false Social Security number (to hide your identity as a prior filer), and the court discovers your action, your case will be dismissed and you may be prosecuted for fraud.
